Limited Warranty

Embedded Works Corporation (" Embedded Works ") warrants that for a period of one (1) year from the date of shipment from Embedded Works that the Embedded Works hardware purchased by Customer ("Hardware") will be free from defects in materials and workmanship under normal use. This limited warranty extends only to Customer as original purchaser. Customer's sole and exclusive remedy and the entire liability of Embedded Works , its suppliers and affiliates under this warranty is, at Embedded Works ' option, either (i) replacement of the Hardware, or (ii) refund of the purchase price of the Hardware (as evidenced by a copy of Customer's purchase receipt), less any rebates or credits.

Embedded Works warrants that for a period of one (1) year from the date of shipment from Embedded Works that the media on which the Embedded Works software purchased by Customer ("Software") is furnished will be free from defects in materials and workmanship under normal use. This limited warranty extends only to Customer as original licensee. Customer's sole and exclusive remedy and the entire liability of Embedded Works , its suppliers and affiliates under this warranty is replacement of the media on which the Software is furnished. Embedded Works makes no warranty with respect to the Software, and specifically disclaims any warranty that the Software is error free or that Customer will be able to operate the Software without problems or interruptions.

Restrictions. No warranty will apply if the Hardware and/or Software (collectively, "Product") (i) has been altered, except by Embedded Works ; (ii) has not been installed, operated, repaired, or maintained in accordance with instructions supplied by Embedded Works ; or (iii) has been subjected to abnormal physical, thermal or electrical stress, misuse, negligence, or accident. In addition, Products are not designed or intended for use in (i) the design, construction, operation or maintenance of any nuclear facility, (ii) navigating or operating aircraft; or (iii) operating life-support or life-critical medical equipment, and Embedded Works disclaims any express or implied warranty of fitness for such uses.
